Terms of Service

Deanna Strachan-Wilson | DSWilsonART, LLC

Last updated: October 30, 2026

Welcome! Thank you for visiting my website and exploring my artwork, classes, and creative offerings.

These Terms of Service explain the policies that apply when you use this website, purchase original artwork, participate in an art class or workshop, or access digital educational materials.

By using this website or purchasing products and services offered by Deanna Strachan-Wilson, you agree to these terms, subject to applicable law.

1. About This Website

This website, deannastrachanwilson.com, is operated by Deanna Strachan-Wilson through DSWilsonART, LLC.

Offerings may include original watercolor and mixed media artwork, prints, online art classes, downloadable instructional materials, creative collaborations, and in-person workshops.

The Whimsy Studio, including its Begin, Build, and Bloom programs, is one part of these creative offerings.

2. Digital Classes and Educational Materials

Digital classes may include prerecorded instructional videos, downloadable guides, supply lists, reference materials, and other educational resources.

Purchasing a class grants you a personal, nonexclusive, nontransferable license to access and use the included materials for your own learning.

Class materials may be downloaded or printed for personal educational use where downloads are provided.

You may not share purchased class access, distribute instructional materials, reproduce class videos, resell materials, or use the instructional content to create competing commercial educational products without prior written permission.

3. Lifetime Class Access

Purchased digital classes include lifetime access, defined as access for as long as the class remains hosted and available through my business.

I intend to provide ongoing access to purchased classes. However, hosting services, delivery platforms, and technologies may change over time.

If a class must be discontinued, I will make reasonable efforts to notify affected customers and provide an appropriate alternative when possible.

Lifetime access does not guarantee that a particular hosting platform or video service will remain available indefinitely.

4. Digital Product Refunds

Because digital classes and downloadable products provide access to instructional content upon purchase, all digital product sales are final and nonrefundable, except where otherwise required by applicable law.

Please review the product description before purchasing.

If you experience difficulty accessing purchased materials, contact me at dswilsonart@gmail.com so I can help resolve the issue.

5. In-Person Classes and Workshops

I teach in-person classes and workshops hosted by independent artists, studios, community organizations, and other agencies.

Registration, payment, cancellation, and refund policies for these events are established by the hosting organization.

Participants should review the host’s policies before registering.

Questions about cancellations, refunds, transfers, or scheduling changes should be directed to the organization handling registration.

When I am not the organizer or payment processor, I do not independently administer registration refunds.

6. Original Artwork and Physical Products

Original artwork is individually created and may include variations in texture, color, and other characteristics inherent to handmade work.

Every effort is made to represent artwork accurately through photographs and descriptions. Colors may appear slightly different depending on screen settings and lighting conditions.

Product descriptions will identify dimensions, materials, and other relevant information.

Unless otherwise stated, original artwork is sold unframed.

Purchasing an original artwork transfers ownership of the physical piece but does not transfer copyright, reproduction rights, or commercial licensing rights.

7. Artwork Returns and Damaged Shipments

I take great care in preparing and packaging artwork for shipment.

Sales of original artwork are generally final, except when artwork arrives damaged, an order is incorrect, or a refund or other remedy is required by applicable law.

If artwork arrives damaged, please contact me at dswilsonart@gmail.com as soon as possible.

Please include photographs of the damaged artwork and packaging, along with your order information.

For artwork confirmed to have arrived damaged, I will provide a refund, including applicable original shipping charges.

Please retain the original packaging while the damage claim is being reviewed.

Additional remedies will be provided when required by applicable consumer protection laws.

8. Shipping and International Orders

Artwork may be shipped domestically and internationally, subject to available shipping services and destination restrictions.

Shipping costs are calculated based on the artwork, packaging requirements, destination, and applicable carrier rates.

Insurance may be included when appropriate.

International customers may be responsible for customs duties, import taxes, and other charges imposed by their country unless otherwise stated at checkout.

Shipping estimates are not guarantees of delivery dates. If an order cannot be shipped within the promised timeframe, customers will be notified and offered the options required by applicable law.

9. Copyright and Intellectual Property

Unless otherwise indicated, original artwork, photographs, class videos, instructional guides, written content, designs, and other original creative materials presented on this website are owned by Deanna Strachan-Wilson or DSWilsonART, LLC, or are used with permission.

These materials are protected by applicable copyright and intellectual property laws.

No content may be reproduced, distributed, sold, licensed, or used commercially without prior written permission, except as permitted by applicable law.

Purchasing artwork, a class, or an instructional resource does not transfer intellectual property ownership.

Students retain ownership of the original artwork they create during classes and workshops, subject to any applicable third-party rights.

10. Artificial Intelligence, Automated Scraping, and Data Mining

All rights are expressly reserved regarding the use of original artwork, images, instructional materials, written content, and other protected creative works for artificial intelligence and machine learning purposes.

Except where expressly authorized in writing or permitted by applicable law, the following activities are prohibited:

  • Scraping, crawling, harvesting, or systematically collecting website content, artwork, images, text, or instructional materials for AI-related purposes.
  • Using website content or creative materials to train, fine-tune, develop, test, or improve artificial intelligence or machine learning systems.
  • Including original artwork, images, written materials, or instructional content in datasets used for generative AI development.
  • Uploading, submitting, or otherwise providing protected creative materials to AI systems for unauthorized reproduction, imitation, or commercial exploitation.
  • Using automated tools to reproduce, transform, or generate substantially similar copies of protected artwork or instructional materials in ways that infringe applicable intellectual property rights.
  • Removing or altering copyright notices, attribution, watermarks, or other copyright management information without authorization.

These restrictions apply to publicly accessible website content as well as purchased or downloaded materials.

Public availability of content does not constitute permission for AI training, automated extraction, or commercial reuse.

Any individual or organization seeking permission to license content for AI-related purposes must obtain prior written authorization from Deanna Strachan-Wilson.

Nothing in this section is intended to prohibit activities expressly permitted by applicable law.

11. Third-Party Platforms and Collaborations

Some classes, workshops, and creative offerings may be hosted, sold, or delivered through third-party websites, art schools, payment processors, or collaborating organizations.

These providers may maintain their own terms, privacy practices, refund policies, and access requirements.

Purchases made directly through third-party providers are subject to the applicable provider’s policies and agreements.

12. Website Availability and Educational Disclaimer

I make reasonable efforts to maintain access to my website and educational resources.

Temporary interruptions may occur due to maintenance, technical difficulties, or third-party service issues.

Art classes and instructional resources are provided for educational and creative purposes. Individual results will vary.

Participants are responsible for using materials and tools safely and following applicable product instructions.

Nothing in these terms limits rights or remedies that cannot legally be excluded.

13. Privacy

Personal information collected through this website, purchases, newsletter subscriptions, and inquiries is handled according to the Privacy Policy.

Please review the Privacy Policy for information about the collection, use, and protection of personal information.

14. Changes to These Terms

These Terms of Service may be updated to reflect changes in business practices, services, or applicable legal requirements.

The most current version will be posted on this website with its effective date.

Updated terms will apply prospectively, subject to applicable law and any existing purchase agreements.
